WayToTech Terms of Use
Effective from: January 1, 2025
1. Definitions
For the purposes of these terms of use:
- Portal - the WayToTech website available at wayto.tech
- Talent - an individual seeking employment who creates a profile on the portal
- Recruiter - a person representing a company in the recruitment process
- Talent Profile - a public or private professional profile created by a Talent
- Administrator - Palapa Sp. z o.o.
2. Acceptance of Terms
By using the WayToTech portal, Talents and Recruiters accept these terms of use and the Privacy Policy. If they do not agree with any of these terms, they should immediately cease using the portal.
Recruiters, by using the portal, confirm that they have appropriate authorization to process personal data in accordance with GDPR and that they are familiar with the obligations arising from data protection regulations.
3. Account Registration
To use the full functionality of the portal, Talents and Recruiters must create an account by providing true and current data. Users are solely responsible for the accuracy and updating of their data.
3.1 Talent Accounts
Talents registering an account declare that:
- They are of legal age or have consent from a legal guardian
- The data provided is true and current
- They have the right to share all information in their profile
- They understand the consequences of publishing a public profile
3.2 Recruiter Accounts
Recruiters registering a company account declare that:
- They are authorized to represent the company in recruitment processes
- The company has implemented GDPR-compliant data protection procedures
- They have a legal basis for processing candidate data
- They commit to using data exclusively for recruitment purposes
4. Talent Profiles
4.1 Creating and Managing Profiles
Talents may:
- Create a detailed professional profile containing experience, skills, and education
- Add portfolio items, certificates, and project examples
- Specify preferences regarding desired employment
- Update their profile at any time
4.2 Profile Visibility
Talents independently decide on their profile visibility:
- Private profile - visible only to Recruiters to whom the Talent has applied
- Public profile - visible to all registered Recruiters
- Anonymous profile - skills visible without personal data
4.3 Responsibility for Profile Content
Talents bear full responsibility for:
- The truthfulness and currency of information in their profile
- Not including sensitive data (e.g., health status, political views)
- Not violating third-party rights (e.g., in portfolio items)
- Respecting copyright for posted materials
4.4 Contact from Recruiters
By publishing a public profile, Talents:
- Consent to contact from Recruiters for recruitment purposes
- May change visibility settings at any time
- May block selected companies from accessing their profile
- Retain the right to ignore messages from Recruiters
5. Applying for Job Offers
5.1 Application Process
When applying for a job offer, a Talent:
- Shares their profile and CV with the company posting the offer
- Consents to data processing in the recruitment process
- May be asked to complete additional tests or tasks
- Receives confirmation of application submission
5.2 Skill Tests
When participating in skill tests, Talents:
- Commit to solving tasks independently
- Accept test monitoring (if required)
- May not copy or share test content
- Receive results only if the Recruiter decides to share them
6. Responsibility for Content and Data Processing
Users bear full responsibility for content they publish or send through the WayToTech portal.
6.1 Talent Responsibility
Talents are responsible for:
- Truthfulness of information in profiles and applications
- Not violating copyright in portfolios
- Updating contact details
- Not misleading potential employers
6.2 Recruiter Responsibility
Recruiters become data controllers of Talent personal data upon receiving access to applications or public profiles. WayToTech serves solely as a data processor, providing technical tools.
Recruiters assume full responsibility for:
- Lawful processing of Talent personal data
- Adhering to data minimization principles - processing only necessary data
- Ensuring security of processed data
- Fulfilling Talent rights under GDPR
- Deleting Talent data after recruitment process completion per regulations
- Informing Talents about how their data is processed
7. Recruiter Obligations for Data Protection
Recruiters using the portal commit to:
- Processing data exclusively for recruitment purposes - prohibition on using Talent data for marketing, sales, or other non-recruitment purposes
- Respecting Talent preferences - contacting only Talents who have consented
- Professional communication - no spam, harassment, or unprofessional messages
- Not sharing data with third parties without explicit Talent consent
- Immediate data deletion after recruitment process completion, unless Talent consented to processing for future recruitments
- Maintaining processing activity records per GDPR requirements
- Reporting data breaches to appropriate authorities within 72 hours
- Responding to Talent requests regarding their rights within 30 days
8. Talent Rights and Obligations
8.1 Talent Rights
Talents have the right to:
- Full control over their profile visibility
- Access to their application history
- Information about application status (if Recruiter provides it)
- Withdraw applications at any time
- Delete their account and all data
- Block selected Recruiters
- Report Recruiter abuse
8.2 Talent Obligations
Talents commit to:
- Providing truthful information
- Not sharing login credentials with others
- Respecting copyright
- Professional communication with Recruiters
- Not publishing offensive or illegal content
9. Use of AI and Automated Processing
The WayToTech portal uses artificial intelligence for preliminary application evaluation.
9.1 Information for Talents
Talents are informed that:
- AI analyzes profile match to job requirements
- Scoring results are not the sole basis for application evaluation
- They have the right to explanation of system logic
- They may request human verification of results
9.2 Recruiter Commitments
Recruiters acknowledge that:
- AI scoring results are only recommendations
- They are obligated to ensure human intervention
- They must inform Talents about AI use
- They bear responsibility for final decisions
10. WayToTech Liability Limitations
WayToTech is not responsible for:
- How Recruiters process Talent personal data after gaining access
- GDPR violations committed by Recruiters, including unauthorized data sharing
- Content posted by users, including false information in profiles
- Recruitment decisions made by Recruiters
- Quality of job offers or Recruiter behavior toward Talents
- Damages resulting from improper data use
- Data loss resulting from force majeure
11. Security and Confidentiality
11.1 Talent Obligations
Talents commit to:
- Not sharing passwords with third parties
- Using strong passwords (min. 8 characters, various character types)
- Immediately reporting suspected account security breaches
11.2 Recruiter Obligations
Recruiters additionally commit to:
- Securing access to company accounts
- Controlling who has access to Talent data
- Not mass exporting data from the portal
- Maintaining confidentiality of Talent data
12. Indemnification and Release of Liability
Recruiters commit to:
- Releasing WayToTech from all liability related to Talent claims regarding rights violations
- Covering all legal costs, damages, and penalties imposed on WayToTech due to improper data processing by the Recruiter
- Immediately informing WayToTech of any complaints or claims
Talents release WayToTech from liability for:
- Content published in their profiles
- Consequences of providing false information
- Copyright violations in portfolios
13. Audit and Control
WayToTech reserves the right to:
- Monitor portal usage
- Conduct compliance audits with terms of use
- Verify truthfulness of information in Talent profiles
- Request GDPR compliance documentation from Recruiters
- Remove content violating terms of use
- Immediately block access upon violation detection
14. Agreement Termination
WayToTech may terminate the agreement with immediate effect in case of:
- Recruiter violation of data protection regulations
- Talent providing false profile information
- Using data contrary to its purpose
- Non-compliance with these terms of use
- Acting to the detriment of other users or WayToTech
- Attempting unauthorized system access
15. Intellectual Property Rights
15.1 WayToTech Property
All WayToTech portal content, including graphic layout, texts, logo, AI algorithms, and other elements are protected by copyright.
15.2 Talent Content
By publishing content on the portal, Talents:
- Retain copyright to their content
- Grant WayToTech a non-exclusive license to display the profile
- Are responsible for not violating third-party rights
- May delete their content at any time
15.3 Prohibition of Copying
The following is prohibited:
- Mass copying of Talent profiles
- Data scraping from the portal
- Using data to create competitive databases
- Recreating portal functionality or design

17. Fees and Payments
17.1 Talent Accounts
Portal use by Talents is free, including:
- Creating and publishing profiles
- Applying for job offers
- Participating in skill tests
- Communication with Recruiters
17.2 Recruiter Accounts
Recruiters pay fees according to their chosen subscription plan. Pricing details are available on the portal website.
18. Final Provisions
WayToTech reserves the right to change these terms of use. Significant changes will be notified to users with 30 days' notice.
Continued portal use after changes are introduced constitutes acceptance of new terms.

19. Reporting Violations
Talents may report:
- Unprofessional Recruiter behavior
- Spam or unwanted messages
- Suspected data protection violations
- Fake job offers
Recruiters may report:
- Fake Talent profiles
- Copyright violations
- Unprofessional candidate behavior

20. Severability Clause
If any provision of these terms proves invalid or ineffective, it does not affect the validity of the remaining provisions. The invalid provision will be replaced by a regulation that best corresponds to the purpose of the invalid provision.
